Background

The Civics and Citizenship Education Hub website (Website) is funded by the Australian Government Department of Education and is managed by Education Services Australia Limited (ESA).

Use of the Website is subject to the terms of use set out below (Terms of Use). Please read and ensure you understand the Terms of Use prior to using the Website. If you proceed to use the Website, your use will be taken as acceptance of the Terms of Use.

ESA may amend the Terms of Use from time to time. You are responsible for regularly reviewing them. Your continued use of the Website constitutes your agreement to the most up-to-date version of the Terms of Use at any given time.

In the Terms of Use, Material means the material including content and resources on the Website and you means the person using the Website. The Website includes Material owned by the Commonwealth and Third-party Material not owned by the Commonwealth.

Ownership and use of Material on the Website

Unless indicated otherwise:

• the Commonwealth of Australia owns all intellectual property rights (including copyright) in the Material (Commonwealth Material); and
• subject to the section below titled ‘Material not available under the licence and terms described above’, you may use the Commonwealth Material in accordance with the Creative Commons Attribution 4.0 International (CC BY 4.0) licence.

The CC BY 4.0 licence allows you to:

• share the Commonwealth Material (copy and redistribute the Commonwealth Material in any medium or format); and
• adapt the Commonwealth Material (remix, transform and build upon the Commonwealth Material for any purpose, even commercially);

provided you attribute (give appropriate credit, provide a link to the licence and indicate if changes were made, but not in any way that suggests the Commonwealth of Australia endorses you or your use.

Material not available under the licence and terms described above

The permission to use Material in accordance with the CC BY 4.0 licence above does not apply to:

• any logos including the Civics and Citizenship Education logo, the ESA logo or the Australian Government Department of Education logo;
• the design of the Website; and
• any other Material protected by a trade mark.

Third Party Material made available under a Creative Commons licence

This Website also contains material that is owned by third parties (Third Party Material). Some Third Party Material may be made available for use under a Creative Commons licence. Please refer to relevant use statements under Acknowledgements about specific material, and links to relevant Creative Commons licences on the Website where the relevant Third Party Material appears.

Third Party Material not available under a Creative Commons licence

Some Third Party Material may be made available for use other than under a Creative Commons licence. Please refer to relevant use statements under Acknowledgments about specific material, and links to relevant licences on the Website where the relevant Third-party Material appears. Any Third Party Material that is not indicated as being made available under a specific licence may be used, reproduced, published and modified for non-commercial educational purposes.

Licence fees not payable to statutory agencies

Where you use the Material in accordance with the Terms of Use, you do not need to comply with the requirements of any statutory licence (for example, pay royalties to a copyright collecting society such as the Copyright Agency) for that Material.

Links to external websites

This Website provides links to third party websites not controlled by ESA or the Commonwealth of Australia (the Commonwealth). The Commonwealth and/or ESA: 

• is not liable for third party websites;
• does not control third party websites;
• makes no depiction of the intellectual property rights for third party website content;
• does not endorse third party websites and third party content or any organisation, product or service associated with those third parties; and
• does not have the power to change any third party websites.

Any access to third party websites is carried out at your own risk, and it is your responsibility to read and comply with the terms of use or legal notices associated with those third party websites.  The onus is with you to consult your skill and judgement of any third party websites to determine the relevance, applicability and accurateness of information.

The Material is provided for your information only and you are responsible for ensuring that the Material is current, complete and accurate before using it.

ESA has endeavoured to ensure the Material provided is accurate, up to date and does not breach any entity’s rights at the time of its inclusion. However, the Material is provided to you on an 'as is' and 'as available' basis and you use it at your own risk.

To the extent lawful, ESA and the Commonwealth:

• exclude all warranties in respect of the Website and the Material; and
• are not liable for any loss or damage, however caused, resulting from the use or inability to use the Website and/or the Material, or caused to your computer or any other property as a result of your use of the Website.

The Website uses the internet to provide services and information. By using the Website you acknowledge and agree to accept all risks associated with using the internet, including potential exposure to harmful code which may affect your device.

Whilst ESA aims to maintain the security of all of its systems, ESA does not warrant or guarantee the security of the Website. The Terms of Use are governed by the laws of Victoria, Australia.
